Terms and Conditions of Website Use | Effective Date: September 4, 2026

Please read these Terms and Conditions (“Terms”) carefully before using the website located at rainydaytx.com (the “Site”), operated by Rainy Day General Contractors LLC, a Texas limited liability company doing business as Rainy Day Roofing, Siding, & Windows (“Rainy Day,” “we,” “us,” or “our”). By accessing or using the Site, requesting information, or submitting a form, you (“you” or “the user”) agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and Rainy Day governing your access to and use of the Site, including any content, functionality, and services offered on or through the Site. By using the Site, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms. We may update these Terms from time to time as described in Section 15 below, and your continued use of the Site after any such update constitutes acceptance of the revised Terms.

2. Description of Services

Rainy Day is a home exterior contracting company providing roofing, siding, and window services, including insurance restoration and retail project work, primarily within the Greater Houston, Texas area. The Site provides general information about our services, service areas, and company, and allows prospective customers to request inspections, estimates, or other information by submitting a contact form or by phone, text, or email.

Any information, estimate, or price range provided through the Site, including through an instant estimate or pricing tool, is provided for general informational purposes only. It does not constitute a binding quote, offer, or contract for services. A final scope of work and price will only be established through an in-person inspection and a written, signed contract.

3. Eligibility and Accounts

The Site is intended for use by individuals seeking information about, or requesting, home exterior services for properties they own, manage, or are otherwise authorized to act on behalf of. If the Site allows you to create an account or submit information on behalf of a business or another person, you represent that you have the authority to do so and that the information you provide is accurate and current.

4. Use of the Website

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Site in any way that violates any applicable federal, state, or local law or regulation;
  • Attempt to gain unauthorized access to any portion of the Site, other accounts, or computer systems connected to the Site;
  • Interfere with or disrupt the operation of the Site or the servers or networks used to make the Site available;
  • Use any automated means, including bots, scrapers, or spiders, to access or collect data from the Site without our prior written consent;
  • Submit false, misleading, or fraudulent information through any form on the Site;
  • Upload or transmit any virus, malware, or other harmful code.

We reserve the right to restrict, suspend, or terminate your access to the Site, at our sole discretion, for conduct that we believe violates these Terms or is otherwise harmful to Rainy Day, other users, or third parties.

5. Intellectual Property

The Site and all content on it, including text, graphics, logos, images, the Rainy Day name, the Rainy Day “Clean Paws” and related branding, and the overall look and feel of the Site, are the property of Rainy Day or its licensors and are protected by U.S. and international copyright, trademark, and other intellectual property laws. You may view and print pages from the Site for your own personal, non-commercial use, provided you do not remove or alter any copyright, trademark, or other proprietary notices. Except as expressly permitted in these Terms, you may not reproduce, distribute, modify, publicly display, or create derivative works from any content on the Site without our prior written consent.

6. User Submissions and Communications

When you submit information through a contact form, estimate request, or other feature on the Site, you grant Rainy Day permission to use that information to respond to your inquiry, prepare an estimate, schedule services, and communicate with you about your project, consistent with our Privacy Policy. You represent that any information you submit is accurate and that you have the right to provide it. Please do not submit any content that is unlawful, defamatory, or that infringes the rights of any third party.

7. Estimates, Quotes, and Project Agreements

Any estimate, price range, or scope of work discussed through the Site, by phone, by text, or by email is preliminary and subject to change based on an in-person inspection, measurement, material selection, and other project-specific factors. No estimate or quote is binding on Rainy Day, and no contract for services is formed, until both parties have signed a separate written service agreement. Insurance restoration pricing may additionally depend on the outcome of the claims and adjustment process with the applicable insurance carrier.

8. Phone, Text, & Email Communication

By providing your phone number or email address through the Site, or otherwise to Rainy Day, you consent to be contacted using the information below.

8.1 Purpose of Communications

These phone numbers will be used to respond to prospective customers’ requests for services from Rainy Day General Contractors LLC (DBA Rainy Day Roofing, Siding, & Windows) or to proceed with the next steps in scheduling their roofing projects once they have agreed to a quote. We only send text messages to contacts who have expressly opted in to receiving text messages from us.

8.2 Opting Out of SMS

You can cancel the SMS service at any time. Just text “STOP” to the short code. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time, and we will start sending SMS messages to you again.

8.3 Help

8.4 Carrier Liability

Carriers are not liable for delayed or undelivered messages.

8.5 Message and Data Rates

As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency may vary. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

9. Third-Party Links

The Site may contain links to third-party websites, including manufacturer sites, financing partners, review platforms, or social media, that are not owned or controlled by Rainy Day. We are not responsible for the content, privacy practices, or terms of any third-party site. Your use of any linked third-party site is at your own risk and subject to that site’s own terms and policies.

10. Disclaimers

THE SITE AND ALL CONTENT, INFORMATION, ESTIMATES, AND MATERIALS PROVIDED THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY ESTIMATE PROVIDED THROUGH THE SITE WILL MATCH THE FINAL PRICE OF ANY PROJECT.

Nothing on the Site constitutes professional, engineering, insurance, or legal advice.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, RAINY DAY AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL RAINY DAY’S TOTAL LIABILITY ARISING OUT OF YOUR USE OF THE SITE EXCEED ONE HUNDRED DOLLARS ($100). This Section does not limit liability arising under a separately signed written service agreement for roofing, siding, or window work, which is governed by the terms of that agreement.

12. Indemnification

You agree to indemnify, defend, and hold harmless Rainy Day and its owners, officers, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your violation of any rights of a third party.

13. Privacy

Your use of the Site is also governed by our Privacy Policy, available at rainydaytx.com/privacy-policy, which describes how we collect, use, and protect your information, including phone numbers used for calling and texting as described in Section 8 above.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. You agree that any dispute arising out of or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in Harris County, Texas, and you consent to personal jurisdiction and venue in those courts.

15. Changes to These Terms

We may revise these Terms from time to time at our sole discretion. The “Effective Date” at the top of this page will indicate when these Terms were last revised. Your continued use of the Site following any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

16. Termination

We reserve the right, without notice and in our sole discretion, to terminate your right to use the Site, or any portion of it, at any time and for any reason, including violation of these Terms. Provisions of these Terms that by their nature should survive termination, including but not limited to Sections 5, 10, 11, 12, and 14, shall survive.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.

18. Entire Agreement

These Terms, together with our Privacy Policy and any separately executed service agreement, constitute the entire agreement between you and Rainy Day regarding your use of the Site and supersede any prior agreements or understandings, whether written or oral, regarding the subject matter herein.
